What is foreclosure?
In California, foreclosure is generally handled out of court, because most "mortgages" in California are actually a slightly different contract called a "deed of trust." If you default on your mortgage, the deed of trust gives a trustee the right to take back the collateral — your house — that you used to secure your loan.
Once a homeowner defaults, the trustee can file a notice of default. The trustee could do it right away, but often waits for several months to do so. The filing of the notice of default starts a time clock which gives the homeowner a chance to pay what they owe, and gives the trustee the right to sell the property if the homeowner cannot do so.
What are my options for foreclosure defense?
The first step in foreclosure defense is to perform a forensic audit to determine if any significant errors were made in the original loan or during the foreclosure process. Certain irregularities can require your lender to re-start the entire foreclosure process.
If fraud was committed by the lender or another party during the origination of your mortgage, it could halt the foreclosure proceedings. It might also allow you to file a mortgage fraud lawsuit that could help you save your home.
If a forensic audit does not reveal errors, there may still be options for foreclosure defense. For example, we can seek a loan modification to reduce the interest rate, extend the loan term, or otherwise lower your payment so you can "catch-up" on delinquent payments.
Can filing for bankruptcy help to save my home?

Filing bankruptcy stops foreclosure proceedings until the bankruptcy is sorted out. Also, the Chapter 13 repayment plan can be used to restructure other debt so that you can afford your mortgage payment.
